This law provides an eligible associate with up to 12 workweeks of job protected, unpaid leave during any continuous 12 month period for reasons as follows:
- Birth and/or care of a newborn child of an associate;
- Placement of a child with the associate for adoption* or foster care;
- Associate's care of a spouse, child, or parent with a serious health condition;
- An associate's own serious health condition which prevents the associate from working**;
- Any qualifying urgent demand (exigency) arising from the associate’s spouse, parent, or child (of any age), who is a member for the Armed Forces and is on covered active duty (or has been notified of an impending call or order to covered active duty) Qualifying exigencies includes 1) short-notice deployment; 2) military events and related activities; 3) childcare and school activities; 4) financial and legal arrangements; 5) counseling; 6) rest and recuperation; 7) post-deployment activities; 8) additional activities.
Employees must have completed at least 12 months of service. This service is not required to be 12 recent or consecutive months. Time served outside the civil service, or as a temporary or intermittent employee, does not count towards this 12-month requirement.
This law provides an eligible Associate with a total of 26 workweeks of unpaid, job-protected leave during a “single 12-month period” to care for a covered service member with a serious injury or illness.
Family Care and Bereavement: Regular full-time associates may use up to 13 workdays of sick leave each leave year for family care and bereavement purposes. The amount of sick leave permitted for part-time associates each leave year for FFLA is pro-rated in proportion to the average number of hours of work in the associate’s schedule each week. Flexible associates are not eligible to use sick leave under FFLA.
Care for a Family Member with a Serious Health Condition: Regular full-time associates may use up to 12 administrative workweeks of FMLA/FFLA sick leave each leave year to care for a family member*** with a serious health condition.**** The amount of sick leave permitted for part-time associates each leave year is prorated in proportion to the average number of scheduled weekly work hours.
* Adoption: Associates may use an unlimited amount of sick leave for adoption-related purposes.
** If you are personally ill, you may elect to substitute sick or annual leave, if available, in lieu of unpaid leave. Your Human Resources Representative can provide more information about substituting paid for unpaid FMLA leave.
*** "Family Member" is defined as: spouse, and parents thereof; children, including adopted children, and spouses thereof; parents; brothers and sisters and spouses thereof; and any individual related by blood or affinity whose close association with the associate is the equivalent of a family relationship.
**** Serious health condition is defined the same as under FMLA.
